NGOs are typically categorized into three forms: Section 8 Company, Society, and Trust. Each of these structures has its own set of advantages, requirements, and legal implications.
NGOs indeed serve as catalysts for addressing critical social issues, spanning essential areas such as education, healthcare, environmental conservation, and human rights. If you are passionate about making a real and meaningful impact and are committed to championing a cause that aligns with your values, gaining a thorough understanding of the intricacies surrounding NGO registration is the crucial first step toward turning your vision into a practical and impactful reality.
An NGO, or Non-Governmental Organization, is a term used to describe a non-profit organization that operates independently of government control. NGOs are typically established by individuals or groups of people who are passionate about addressing various social, environmental, or humanitarian issues. These organizations work to promote and pursue a wide range of causes and initiatives, often with the goal of improving the well-being of society and the world at large.
NGOs can be registered under various legal structures depending on the country's laws and regulations. The most common types of NGO registration include:
Section 8 Company (or Section 25 Company): This legal structure is typically used in India. Section 8 of the Companies Act, 2013, allows for the incorporation of non-profit companies with limited liability. These companies are formed for promoting art, science, commerce, sports, education, research, social welfare, religion, charity, and protection of the environment.
Society Registration: Societies are registered under the Societies Registration Act, 1860 (in India). They are commonly used in India and some other countries. Societies are suitable for organizations operating at the regional or state level. They are governed by a governing body and typically have a constitution or bylaws.
Trust Registration: Trusts are typically registered under the Indian Trusts Act, 1882 (in India). They are used for organizations that have a charitable or religious purpose. Trusts involve the transfer of property or assets to a group of trustees, who manage the trust for the benefit of a specific group or for charitable purposes.
Note:To ensure that your company name does not resemble the name of any other already registered company and does not violate the provisions of emblems and names (Prevention of Improper Use Act, 1950), you can use a company name search tool provided by your local business registration authority or a relevant government agency. These tools are typically available on official government websites and allow you to check the availability of your desired company name.
